房产买卖中,律师做些啥

购买民用房产,律师的工作:

  1. 浏览买房合约

  2. 和买家进行沟通,确认服务范畴

  3. 进行产权调查和针对卖家的注册债务调查

  4. 进行产权外调查,通常包括:地税,水费,城市建筑条例合规;公寓管理报告审查

  5. 根据产权及产权外调查中的结果,向卖家律师发出查权信,提出交接前要解决的事项,以及需要修补的产权瑕疵

  1. 接收并核查卖家律师准备的交接平衡帐及交接文件

  2. 贷款文件:

    1. 机构类贷款 (来自银行和信用机构的贷款): 买家律师直接从银行的贷款中心接收文件,并根据银行的要求准备贷款文件;在此类交易中,律师既为买家服务,也为银行服务,既要保护买家利益,也要保障银行利益。

    2. 私人贷款 (来自个人或非银行类公司的贷款): 买家律师从私人贷款Lender的律师办公室接收贷款文件,并进行审阅核查;在此类交易中,买家律师只代表买家,不代表Lender. 

  3. 代收代缴土地转让税(Land Transfer Tax):律师代收,并在过户当天通过电子产权注册系统直接上缴给收税的政府机构:

    1. 多伦多市内:两笔土地转让税,一笔交给安省财政厅,一笔交给多伦多市财政

    2. 出了多伦多市,安省其他地区:一笔土地转让税,交给安省财政厅

    3. 海外买家税:在常规土地转让税之上附加的税项, 同样通过电子注册系统代缴给安省财政厅

  4. 购买产权保险:

    1. 屋主保险

    2. 贷款保险

  5. 根据贷款银行的要求,提醒买家安排房屋保险/ 公寓单元财产保险

  6. 和买家见面,解释并签署所有的交接文件

  7. 接收卖家签署的交接文件和钥匙

  8. 在过户日当天,和卖家律师协作,通过安省的电子产权注册系统完成过户手续

  9. 过户正式完成后,将钥匙转交买家

  10. 交接后向买家提供报告和账单

  11. 交接后向银行类贷款机构提供报告


出售民用房产,律师的工作:

  1. 浏览卖房合约

  2. 和卖家沟通,确认服务范畴

  3. 收集准备交接文件的必要信息和文件,包括:

    1. 地税单及付款证明

    2. 公寓物业费数目和付款证明

    3. 当前贷款的年节单或月结单

    4. 确认卖家的税务居民身份

    5. 确认房产的债务情况 (除贷款外是否有其他债权注册或纠纷)

    6. 确认房屋是否为婚姻房,是否需要配偶的签字许可

  4. 接收买家的查权信,浏览产权注册情况,修补产权瑕疵

  5. 向当前的贷款机构发信,获得贷款偿还注销账单

  6. 接收经纪公司的佣金账单

  7. 准备交接平衡帐

  8. 准备交接文件给卖家签署

  9. 接收卖房款项,在付清银行贷款,经纪公司佣金余额,或任何地税及公寓管理费欠费后,将尾款交付卖家

  10. 交接后向卖家提供账单和报告

  11. 追踪卖家贷款的注销
